1. Introduction

MwalimoTech (“we,” “us,” or “our”) operates this website and digital ecosystem to provide professional IT services and cloud solutions, including website design, development, domain registration, graphic design, and our cloud-based Point of Sale (POS) SaaS platform. These Terms govern your use of our site and services.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use our services and platform. By using this website or registering a POS account, you confirm that you meet this requirement.

3. Use of the Website and Platform

• You agree to use the site and POS platform only for lawful, authorized business and commercial purposes.
• You may not misuse the website or POS infrastructure in any way that could damage, disable, or impair system performance or user access.
• You may not use our proprietary content, code structures, or SaaS layout designs for commercial purposes without explicit written consent.

4. Services Offered

Our service suite includes but is not limited to:

Custom software features and digital modules may be offered based on client requests and specific service level agreements.

5. Quotations and Payments

All project quotes provided are valid for 14 days unless otherwise stated. A deposit or upfront subscription payment is required before project commencement or POS account activation. Final payments must be made before project handover or platform launch. MwalimoTech reserves the right to suspend services for late or non-payment.

6. POS SaaS Subscriptions and Renewals

Access to pos.mwalimotech.co.ke is provided on a recurring subscription basis (monthly/annual). Subscriptions automatically renew unless cancelled prior to the billing cycle end date. Failure to renew on time may result in temporary suspension of your POS terminal access until payment is verified through our automated ledger or payment channels.

7. Merchant Data and Multi-Tenant Security

As a merchant utilizing our SaaS POS platform:

• You retain absolute ownership of all transactional records, inventory items, and customer logs generated through your POS account.
• MwalimoTech implements robust database isolation protocols to safeguard your business metrics; however, merchants are strictly responsible for maintaining the confidentiality of their staff login credentials and user PINs.
• We perform regular system backups, but merchants are strongly advised to periodically export critical sales reports and inventory ledgers for local archiving.

8. Hardware Compatibility and Network Dependencies

While our POS platform is optimized for modern web browsers, tablets, and mobile POS terminals, MwalimoTech does not guarantee compatibility with obsolete hardware, unsupported thermal receipt printers, or unstable local barcode scanners. The POS system requires an active internet connection for real-time synchronization, cloud inventory updates, and mobile payment processing.

9. Inventory Management and Pricing Accuracy

MwalimoTech provides the software architecture for stock tracking, sales reporting, and receipt generation. The merchant is solely responsible for the accuracy of input prices, tax configurations, stock counts, and regulatory compliance (such as electronic tax register / ETIMS integration requirements where applicable) within their specific retail outlet.

10. Revisions and Project Timeline

• Each custom development project includes a set number of revision rounds as agreed in the deployment proposal.
• Excessive modifications or adjustments outside the initial scope matrix may incur extra operational charges.
• Delays caused by the client (e.g., delayed system content or feedback loops) will inherently impact the baseline delivery timeline.

11. Client Responsibilities

You are responsible for:

• Providing completely accurate information and asset content for your project pipeline or POS business profile.
• Approving dynamic designs and systemic deliverables on time.
• Ensuring complete compliance with your specific industry laws and business regulations.

12. Intellectual Property

All source code, asset content, and design matrices provided by MwalimoTech remain our exclusive intellectual property until full framework or project payment is balanced. After complete verification of payment, full ownership of custom deliverables is securely transferred to the client unless otherwise agreed. We reserve the right to display completed modular projects and SaaS snapshots within our public studio portfolio unless requested otherwise in writing.

13. Limitation of Liability

MwalimoTech shall not be held liable for:

• Loss of database records, systemic data, or structural revenue due to unforeseen service interruptions or hardware failures.
• Delays initialized by third-party infrastructure providers (e.g., upstream cloud hosting environments or payment gateway APIs).
• Any direct, indirect, or incidental damages resulting from the use or execution of our tech blueprints and POS software.
